Terms & Conditions for Onam Campaign 2025 – Ebco Niranjonam

These Terms and Conditions (“Terms”) is a legal agreement between you and EBCO Private Limited (“Organiser”).

This Terms affects your legal rights and obligations and by entering into this Terms, you confirm that you are competent to contract under the relevant local laws and represent, warrant, and agree that you have read, understood, and hereby agree to be bound by the terms of this Terms and to all additional guidelines, restrictions or rules that may be posted in connection with the Terms. Further, you represent that you have requisite power and authority to enter into this Terms.

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules framed thereunder, as applicable and amended from time to time, pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

You shall be deemed to have accepted this Terms if you or your representative:
i. assents to these Terms in writing or click an “accept” or similar button; or
ii. accepts or utilizes any part of the services or avails pursuant to the Terms; or
iii. receives a voucher in relation to the Program; or
iv. takes any other action evidencing your acceptance of the benefits of any part of this Terms.

This promotional campaign called Ebco Niranjonam (“Program”) is organized by the Organiser. This Program will be governed by the following Terms & Conditions (“Terms”) and the customers availing the benefits under the Program as per the eligibility criteria as set out herein (“Participant”) agree that they have read and understood these Terms and by their participation in the Program, Participants agree to be bound by these Terms. The Organiser reserves the right to cancel or amend the Program, Program Period and the Terms of this Program at any time without any prior notice. Any changes will be posted on the Organiser’s official website or will be communicated through the Authorized Dealers.

In the event of any inconsistency between these Terms and any brochure, scratchcard, marketing or promotional material relating to the Program, these Terms shall prevail.

1. Program Period
a. The duration of this Program starts from 1st July and will end on 31st August (“Program Period”), the duration within which purchases of the Products by various Participants subject to the eligibility criteria as set out herein, shall be considered for the purpose of this Program. It being clarified that any purchases of Products made before or after the Program Period will not be considered while deciding the winners of this Program.

2. Eligibility
a. The Program is confined to the state of Kerala only. The Participants can any avail the benefits of the Program on purchase of the Products only through authorized dealers of the Organiser (“Authorized Dealers”) in Kerala.
b. Persons who are deemed ‘incompetent to contract’ within the meaning of the Indian Contract Act, 1872 are not eligible to avail the Gift under the Program.
c. For participating in this Program, the Participant must have made one time purchase of the Products worth Rs. 20,000/- (Rupees Twenty Thousand only) exclusive of applicable taxes, net of all returns, exchanges, during the Program Period from Authorized Dealers. It is hereby clarified that the purchase of the Products of a minimum in parts of the quantum set out hereinabove shall not be included in the Program. “Products” for the purpose of this Program shall mean the products of the Organiser sold through the Authorized Dealers in the state of Kerela, purchased by Participant with a valid invoice or proof of purchase, where the Product is accepted by the Participant to its satisfaction without any claims of any nature whatsoever including returns, exchange, manufacturing breach etc, against the Organiser.
d. Organiser’s employees, consultants, agents, affiliates and its Authorized Dealers will not be eligible to participate in the Program and shall be subject to disqualification and cancellation of the voucher with immediate effect.

3. Program Mechanism
a. Upon fulfilment of the eligibility criteria in clause 2, the Participants may be entitled to free gifts at the sole discretion of the Organiser (“Gift”).
b. Upon fulfilment of the eligibility criteria, the Authorized Dealer shall handover a physical voucher containing a scratch card to the Participants. The Participants on scratching the physical voucher card would receive a receive a code (“Voucher Code”) along with QR code which shall be scanned by the Participants.
c. The Participant(s) shall submit the following required information:
• Full Name,
• Phone No
• Voucher Code (1 time use),
• File Upload (picture of the invoice / bill)
d. All information to be provided by the Participant for the purpose of this program shall be true, correct, and accurate.
e. On submitting the above required information, the Gift will be revealed. The Organiser and Authorized Dealer shall not be liable and responsible for the Gift revealed. The allotment of Gift shall be as per the outcome of the scratch code and at the final discretion of the Organiser and the same shall not be challenged by the Participants at any time.
f. Upon the reveal of the Gift, (1) it shall be the Participant’s obligation to collect such Gift from the location and within such timeline as shall be communicated by the Organiser/Authorized Dealer. For e.g. for base Gifts such as dry iron, electric kettle and lunch boxes, subject to availability with the Authorized Dealer of such a Gift, shall be collected by the Participant from the Authorized Dealer on the same day of purchase and redemption of voucher. However, if such a base Gift is not available with the Authorized Dealer, the Participant can collect the Gift within the timelines as intimated by the Authorized Dealer or as may be instructed by the Organiser or as displayed at the time of redemption of voucher. For Gifts such as television, or Mixer, it may be delivered to the address provided by the Participants, as intimated by the Authorized Dealer or as may be instructed by the Organiser or as displayed at the time of redemption of voucher. If the Gift is a vehicle, the same shall be delivered to the address mentioned as per Clause 3(c) or otherwise as intimated by the Authorized Dealer or as may be instructed by the Organiser or as displayed at the time of redemption of voucher and such Gift shall be collected by the Participant from location and within a time period to be decided at the sole discretion of the Organiser. However, the Organiser or the Authorized Dealer shall not be liable if the Participant fails to collect/receive such Gift or if the Participant fails to make the payment of charges, costs, expenses, taxes, as stipulated under the Terms herein or if the Participant fails to undertake the required acts, deeds and documentation as may be required by the Organiser and / or the Authorized Dealer, or the Gift could not delivered by the Organiser due to incorrect or inaccurate details, information, address and / or credentials being provided by the Participant. The Organiser reserves the right to change the delivery timeline of the Gifts at its sole discretion and without any claims, objections or challenges to such decision of the Organiser.
g. If the Organiser attempts to deliver the Gift to the Participant but is unable to deliver it due to any breach or fault of the Participant including non-availability, absence of the Participant, wrong address or any other related breach, then the Organiser shall have discretion to take the final decision on the validity of the Program with respect to such Participant and the Participant shall have no right to claim, object or challenge the decision of the Organiser.
h. If the Participant causes a breach of any of these Terms, determined at the sole discretion of the Organiser, then the Participant shall be deemed to have waived its rights to receive any benefit and Gifts under this Program without any liability to the Organiser and the Authorized Dealer.

4. General Terms & Conditions
a. Only one Gift / Gift voucher will be issued per order and per person during the Program.
b. If the Participant returns the Product, then the Participants right to the voucher for claiming the Gift shall also lapse and the Participant will be disqualified from the Program, unless the accepted Product continues to have a value of Rs. 20,000 (Rupees Twenty Thousand only) exclusive of any applicable taxes.
c. The Program including Gift, their allotment, delivery and other related provisions shall be governed at the sole discretion of the Organiser and the Organiser will not entertain any claims or challenges from the Participants with respect to the Program.
d. The vouchers are non-transferable in nature and can be availed only by the customer who purchases the Products as per the eligibility terms as set out herein. No duplicate will be issued if the voucher is lost or misplaced. The Gifts cannot be substituted with any other item, cash, cheque or credit.
e. The Organiser shall reserve the right at its absolute discretion to alter, substitute and / or modify any of the Gifts, at any time without prior notice due to any reasons whatsoever.
f. The Organiser reserves the right to terminate the participation of any person who it reasonably suspects has violated or infringed any of these Terms and the Organiser reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to the Program and its submission process.
g. In the event of any disparity and dispute, the decision of the Organiser shall always be final and binding upon the Participants and the Authorized Dealers.
h. Any tax payable on the Gifts being awarded or received will be the responsibility of the Participant. All Gifts are accepted entirely at the risk of the Participant and are awarded by the Organiser and/or Authorized Dealer on an “as is” basis and without any warranty of any kind express or implied.
i. Organiser makes no representation or warranty in relation to Gifts provided and to the fullest extent permitted by law, the Organiser shall have no liability to the Participant in relation to any Gift, its fitness for purpose, merchantability or otherwise. Warranties or guarantees, if any offered on the Gifts by the original manufacturer or owner, can be claimed by Participant directly against such original manufacturer or owner without any claims on the Organiser or Authorized Dealer. The Organiser or the Authorized Dealer shall not be made a party to any litigation, claims, disputes pertaining to any such liabilities, warranties and guarantees on the Gift.
j. By entering the Program, the Participant indemnifies the Organiser and the Authorized Dealer against any and all actions, claims, damages, expenses, losses, costs, expenses, suits, proceedings or liabilities suffered or incurred directly or indirectly by the Organiser and the Authorized Dealer in consequence of any breach or alleged breach, non-performance or non-observation by the Participant of any agreement, conditions, obligation or warranty on the part of the Participant herein or any fraudulent activity or misconduct by the Participant or any person acting on their behalf.
k. The Organiser reserves the right to disqualify and/or exclude any entries of the Participant from the Program and / or exclude availing of the Program benefits including Gifts, for any reason and for no reason, including without limitation, violation or breach of any portion of these Terms. Further, the Organiser reserves a right to amend, suspend or cancel the Program or any terms herein at any time without any claims.
l. The Organiser will provide Gift and all other expenses, taxes, insurance cost, other costs and expenses in relation to or incidental or ancillary to the Gifts shall be borne and paid at all times by the Participant, failing which, the Gifts will not be given to the Participant and Participant shall be deemed to have voluntarily ousted itself from the Program and the voucher will be considered invalid, without any claims or liabilities on Organiser or Authorized Dealer.
m. These Terms for the Program are governed by the laws of India and the courts of Mumbai shall have exclusive jurisdiction to deal with any matter arising thereof.

General
These terms of sale (“Supply Terms”) apply to products purchased via https://ebco.in (“online shop” or “Website”) which is a website managed by Ebco Private Limited, a company incorporated under the Companies Act, 1956, (“Company” or “Ebco” or “We” or “Us”) having its registered address at 402-3 Hyde Park, Saki Vihar Road, Mumbai 400 072. Under these Supply Terms, the users of the website will be referred to as (“You” or “Your” or “Yourself” or “User” or “Customer” or “Customers”).
Please read the terms of sale carefully before purchasing any products on the Website. Any purchase made by you through the website shall signify your acceptance of the supply terms and your agreement to be legally bound by the same. In addition to the above, you shall also be bound by installation (fitting) instructions, care instructions, warranty and returns information specified on each product page.
If you do not agree with the supply terms, please do not access the website for any purchase.

Business
The Website is a platform that facilitates the online sale of products (“Product” or “Products”) manufactured, traded, or imported by Ebco, to end users, via its regional distributors (“Distributor” or “Distributors”). Ebco has the right to change or discontinue any Product at any time, without prior notice. Ebco may add or modify the procedures, modes, processes or conditions of purchase at any time. Ebco shall not be liable to you or to any third party for any modification, suspension or discontinuance of any Product or any aspect/feature/finish of the Products.

Products
Ebco manufactures and/or imports a wide variety of furniture fittings that can be used in furniture to help improve its efficiency and comfort of use, as well as aesthetics. The Company will ship these Products from the Distributor that is located closest to the Customer.

Pricing and Availability
The pricing information related to the Product shall be as disclosed to you at the time of your purchase. Prices and availability are subject to change without notice or any consequential liability to you. While Ebco strives to provide accurate information relating to Products including pricing information, typographical and other errors may occur. In the event that a Product or service is listed at an incorrect price or with incorrect information due to an error, Ebco may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Ebco will have the right to modify the price of the Product and contact you for further instructions via the email address that you provided at the time of registration, or cancel the order and notify you of such cancellation. If Ebco cancels the order after the payment has been processed, the said amount will be remitted to your account from which the payment was made.

Credit Cards / Debit Cards
In case you choose to pay by Credit Card or Debit Card, you will be required to credit or debit card details to the approved payment gateways while making the payment. In this regard, you agree to provide correct and accurate credit / debit card details to the approved payment gateways to complete the purchase of Products on the Website. You shall not use any credit / debit card that is not lawfully owned by you. The information provided by you will not be utilized or shared with any third party unless required in relation to fraud verifications or by law, government regulations or court orders. You will be solely responsible for the security and confidentiality of your credit / debit card information. Ebco expressly disclaims all liabilities that may arise as a consequence of any unauthorized use of your credit / debit card.

Delivery and Locations
Your pin code will be verified with the database of Ebco before you proceed to pay for your purchase. If your location is not serviceable, you will not be able to proceed to add the item you wish to buy, to your shopping cart. If your location is serviceable, you will be able to proceed to order the items that you wish to buy, to your shopping cart and then proceed to payment/confirmation of the order. Upon successfully ordering your product, you will receive a confirmation email. You can expect your order to be delivered within 7-10 business days from the date of your order confirmation email. However, in some cases, due to various reasons, it may take longer than 7-10 business days from the date of your order for Ebco to deliver any/all products. In such a case, Ebco will be in touch with you via the email address that you provided. In the case that you are not available to take delivery of the order, the Distributor shall make a maximum of three (3) attempts to deliver the order. In case that you are not reachable/contactable or do not accept delivery of products in these attempts, Ebco has the right to cancel the order at its discretion.
If your location is not serviceable, we request you to provide us with an alternate shipping address which is serviceable. If there is any dispute regarding the shipment of the Product for the area not covered by Ebco, Ebco will not be responsible for the non-delivery of the product. Ebco does not deliver items internationally (i.e. any territory outside the internationally marked borders of India). However, you can make purchases on the website from anywhere in the world provided that you ensure that the shipping address is within India. In case you order multiple orders for Products in one transaction, efforts will be made to ship all Products together. However, this may not always be possible. If you purchase multiple Products in a single transaction, you may only provide a single shipping address for your order.

Warranty
Our Products come with a 12 month warranty against any manufacturing defects. The warranty does not cover damages due to incorrect and inaccurate installation of the product. For any guidance or help required with installation, please email us at help@ebco.in with your order number and a scanned copy of the invoice. The warranty does not cover any usage of the product beyond its intended use and wear and tear in the natural course of product usage. The Warranty is only valid against an original invoice received at the time of purchase.

Returns / Refund
All sales are final, except in the case of any manufacturing defects. For any manufacturing defects, we offer easy replacements. In case, you receive a damaged product, please contact us within 7 days of receipt. Email us a few photographs with the order number and a scanned copy of the invoice to help@ebco.in. We provide an exchange with same product. We do not offer refunds.
Upon receiving your complaint, Ebco shall verify the authenticity and the nature of the complaint and if Ebco is convinced that the complaint is genuine, Ebco will proceed to replace the product. If the complaint is frivolous or baseless, Ebco reserves the right to take legal actions against you and you will be solely liable for all costs incurred by Ebco in this regard. In the case that the Product is damaged in transit on the way from the Distributor to you, Ebco is not liable to replace any and all Products that were included in the order. However, in the case of transit damage, it rests solely at the discretion of Ebco to process any replacements on a case-by-case basis. If you believe that you have received a Product that has been damaged in transit, please email us a few photographs with the order number and a scanned copy of the invoice to help@ebco.in.
In order to return any Products, you are required to comply with the conditions and steps below:
Please notify Ebco of receipt of a damaged/defective Product within 7 days of delivery to you. If you are unable to do so within 7 days, Ebco shall not be held liable to replace the order;
Products should be unused;
Ebco will arrange pick-up of the damaged/defective Product through its Distributor. If Ebco is unable to do so, Ebco will notify you regarding the same and you will be required to dispatch the product using a reputed courier in your respective area within one (1) day from receipt of such notice. Courier freight charges will be reimbursed in such form as is determined by the logistics team upon prior consultation with Ebco;
Products should be returned in their original packaging along with the original labels, fitting instructions and invoices etc.
The return package should be strongly and adequately packaged so that there is no further damage of products during transit;
The returned Products are subject to verification and checks by Ebco in order to determine the legitimacy of the complaint/return. If the claim is not legitimate, you will be required to bear the shipping costs for the product.
These conditions will not apply to Products where the defects could not, using reasonable diligence, have been discovered, at the time of delivery.
If a Product returned is duly accepted by Ebco, the value of such Product, as originally paid by you will be refunded to you. Refund will be processed based on the mode of payment and Ebco or the approved payment gateway will credit your refunds directly into your debit/credit card or online accounts or provide you with a cheque in this regard. Refunds will be subject to the following:
Orders paid online will be refunded within 7-21 working days through the online account or via cheque, depending on the then current circumstances as determined by Ebco;
For Cash on Delivery payments, you will be provided with a refund cheque or cash.
If the Product can be repaired, Ebco will get the same repaired and send it back to you.

COPYRIGHTS
All content on the Ebco Platform, including text, graphics, and sound, is protected by copyright and owned or licensed by Ebco Pvt Ltd. You are permitted to use this content on your personal computer for identifying products, making purchases, processing returns and refunds, and for personal use such as viewing and printing. However, you are not allowed to copy, distribute, download, display, modify, or use the Ebco content for any purpose other than personal use. Additionally, you cannot copy and distribute the content on other servers or systems, reproduce any part of the Ebco Platform for commercial gain, remove copyright or trademark notices, or link any other material to the Ebco Platform without permission.
The license granted to you does not allow for the resale of products, commercial use of the platform or content, collection and use of product listings, descriptions, or prices, using the platform or content in ways not specified in the Terms of Use, downloading or copying user login credentials, or using data mining or extraction tools on the platform. You are also prohibited from creating and publishing a database that features parts of the Ebco Platform. Indemnification of Limitation of Liability
You agree to indemnify, defend and hold harmless Ebco from and against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Ebco that arise out of, result from, or may be payable by virtue of, any breach of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Supply Terms applicable to the purchase of Products.
In no event shall Ebco, its officers, directors, employees, partners or vendors be liable to You, the Distributor or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits, whether or not foreseeable or whether or not Ebco has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your purchase of the products and services herein. Notwithstanding anything to contrary, Ebco’s entire liability to you under the Supply Terms or otherwise shall be not more than the value of the Product that you ordered.

Governing Law
These Supply Terms and the relationship between you and Ebco shall be governed in accordance with the laws of India without reference to conflict of laws principles.
All claims, differences and disputes arising under or in connection with or in relation to the Supply Terms or any transactions entered into on or through the Website or the relationship between you and Ebco shall be subject to the exclusive jurisdiction of the courts at Mumbai and you hereby accede to and accept the jurisdiction of such courts.

You can review the latest version of the Terms of Service at any time on this page. We have the right to update, change, or replace any part of these Terms of Service at our sole discretion by posting updates and changes on our website. It is your responsibility to check our website periodically for these changes. By continuing to use or access our website or the service after we post any changes to these Terms of Service, you agree to accept those changes.
